Terms of Service

These Terms of Service constitute a legally binding agreement made between you and KSeF Guard (operated by Hicham Benkaihoul, “KSeF Guard Engineering”) concerning your access to and use of the KSeF Guard application and website.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to download, install, and use the Application for your internal business purposes strictly in accordance with your chosen subscription tier.

You may not: (a) decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Application; (b) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the Application; (c) violate any applicable laws, rules, or regulations in connection with your access or use of the Application.

The Application, including all code, design, content, trademarks, and documentation, is the exclusive property of KSeF Guard. Your license does not grant any ownership rights. The validation rule descriptions and legal citations are provided for informational purposes and remain the intellectual property of their respective sources.

KSeF Guard is offered in three plans: Free (up to 10 file validations per day, enforced locally), Standard (up to 5,000 validations per day), and Pro (unlimited validations). The Free plan is available free of charge for as long as it is offered and includes the software functionality as it exists at the time of use, together with minor bug fixes; it is a perpetually free tier, not a paid “lifetime” license.

Paid subscriptions are billed on a recurring (monthly or annual) basis and auto-renew unless cancelled before the end of the current billing period. Billing, invoicing, VAT, and payment are handled by DodoPayments, which acts as Merchant of Record; prices are charged in EUR. Major new versions or entirely new regulatory paradigms may require a separate upgrade license. Refunds are governed by our Refund Policy.

A successful (“PASS”) validation result is advisory only. It does not guarantee that KSeF will accept your invoice, nor that the invoice satisfies all applicable legal and tax obligations. KSeF Guard intentionally applies stricter checks than the KSeF API and may flag issues that KSeF would still accept. Final acceptance is determined by the KSeF platform and by factors outside the Application's scope (for example, authorization, permissions, and account or session state). You remain solely responsible for the correctness and compliance of your invoices.

KSeF Guard is a validation tool and does not constitute tax or legal advice. Validation results are for informational purposes only. We are not liable for any damages arising from reliance on the Application's output, including but not limited to rejected invoices, tax penalties, or business losses. Our maximum liability is limited to the amount you paid for the Application in the 12 months preceding the claim. This limitation does not apply to damages arising from gross negligence or willful misconduct.

The Application is provided “as is” without warranty of any kind, express or implied. We do not warrant that the Application will be uninterrupted, error-free, or that validation results will be 100% accurate. We make reasonable efforts to keep rules current with Polish tax regulations but cannot guarantee immediate updates following regulatory changes.

For material breaches (e.g., reverse engineering, redistribution), we may terminate or suspend your access immediately without prior notice. For non-material breaches, we will provide 14 days written notice (by email to the address associated with your purchase) and an opportunity to cure the breach before termination. Upon termination, your license ceases and you must uninstall the Application. Sections regarding intellectual property, limitation of liability, and governing law survive termination.

These Terms are governed by and construed in accordance with the laws of the Republic of Poland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Poland.

We reserve the right to modify these Terms at any time. Material changes will be communicated via the website or email. Continued use of the Application after changes constitutes acceptance of the updated Terms.
